1. Acceptance of Terms
By accessing or using CoachNexa ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and CoachNexa, operated by TechChase Digital Solutions ("Company", "we", "us", or "our").
2. Description of Service
CoachNexa is a SaaS (Software as a Service) platform designed for professional coaches to manage their clients, sessions, invoices, resources, habits, and other coaching-related workflows. The Service provides tools for coaches ("Coach Users") and their clients ("Client Users") to collaborate digitally.
3. Account Registration
To use CoachNexa, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@coachnexa.com of any unauthorised use of your account.
4. Subscription Plans and Billing
CoachNexa offers paid subscription plans (Professional Coach, Thriving Practice, and Coaching Firm). Paid plans are billed in advance on a monthly or annual basis in Indian Rupees (INR). All payments are processed securely through Razorpay.
By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis. Prices may change with 30 days' notice. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
All prices are exclusive of applicable taxes (including GST). You are responsible for any taxes applicable to your subscription.
5. Free Trial
New Coach accounts may be eligible for a 14-day free trial of paid features. At the end of the trial period, you will be prompted to select a plan to continue using premium features. We reserve the right to modify or discontinue trial offers at any time.
6. Cancellation and Refunds
You may cancel your subscription at any time. Please refer to our Refund & Cancellation Policy for full details on cancellations, refunds, and how account data is handled after cancellation.
7. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Harass, abuse, or harm another person
- Upload or transmit malware, viruses, or harmful code
- Attempt to gain unauthorised access to any part of the Service
- Use the Service for any fraudulent or deceptive purpose
- Resell, sublicense, or redistribute the Service without prior written consent
8. Data Ownership and Privacy
You retain ownership of all data you upload or create on CoachNexa. By using the Service, you grant us a limited licence to process your data solely to provide the Service. We will not sell your data to third parties. Please review our Privacy Policy for details on how we collect, use, and protect your information.
9. Intellectual Property
The CoachNexa platform, including its software, design, logos, and content created by us, is the intellectual property of TechChase Digital Solutions. You may not copy, modify, distribute, or create derivative works from our platform without explicit written permission.
10. Limitation of Liability
To the maximum extent permitted by law, TechChase Digital Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising out of your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months prior to the event giving rise to the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We will make commercially reasonable efforts to maintain uptime and data integrity.
12. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may also terminate your account by contacting us at support@coachnexa.com. Upon termination, your right to use the Service ceases immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by email or via an in-app notice. Your continued use of the Service after such notification constitutes your acceptance of the updated Terms.
